Supreme Court strikes down federal anti-sports gambling law

"Now, legalized sports gambling will be a factor in the sports scene in the United States starting very shortly". The move likely opens the gates for more of states around the country to get into the sports betting business including Florida.

Here's the current rundown of gambling legality by state.

In this case, Murphy v. NCAA, New Jersey's argument is that PASPA is unconstitutional, violating the Tenth Amendment of the Constitution, which prohibits the federal government from infringing on states' rights. It stated that states could not sponsor sports gambling, although it was grandfathered in four states - Nevada, Delaware, Oregon and Montana - which previously had established legal sports gambling regulations.

Monday's ruling does not legalize sports betting in other states, but it permits states to follow New Jersey's lead by repealing state restrictions on sports gambling. It would allow the state's casinos and horse betting tracks to offer sports betting, overseen by the NJ Division of Gaming Enforcement.

Justice Samuel Alito wrote for the court, "The legalization of sports gambling requires an important policy choice, but the choice is not ours to make". "Congress permissibly exercised its authority to regulate commerce by instructing the states and private parties to refrain from operating sports-gambling schemes", she wrote. The tour's position is similar to the National Basketball Association and Major League Baseball on gambling issues and it says it will continue to work with state legislators and regulators.

The U.S. appeals court in Philadelphia struck down this measure because it had the obvious impact of legalizing gambling that was forbidden under federal law. Garafalo, a Republican from Farmington, has already been pushing for legislative action in anticipation of the Supreme Court ruling. Gov. Chris Christie argued that PASPA amounted to commandeering, forcing states to enforce a law they didn't want. Christie served as an advisor to President Donald Trump during the 2016 presidential race but was ousted as the head of Trump's transition team after the election.

Although the Supreme Court still has until the end of next month to make the decision, New Jersey is remarkably optimistic.

Casino chain MGM Resorts said last week when meeting analysts that it believes 10 to 12 states could legalize sports betting fairly quickly after a favorable ruling.

Major League Baseball released a statement saying the decision will have "profound effects" on the sport. "In the 2018 legislative session, I promise to introduce legislation that will regulate and legalize sports gambling in Minnesota".
